Copyright Policy (DMCA / 17 U.S.C. § 512)

Effective date: August 25, 2026. Last updated: August 25, 2026.

Epsilon9 doing business as Staytute (“Staytute,” “service provider,” “we,” “us”) respects copyright and complies with the Digital Millennium Copyright Act, 17 U.S.C. § 512, including designation of an agent to receive notifications of claimed infringement.

This policy applies to staytute.com, westport.staytute.com, and other Staytute-hosted Services that store material at the direction of users (including complaint photos, operator documents, and similar uploads).

Designated agent

Under 17 U.S.C. § 512(c)(2), notifications of claimed infringement must be sent to Staytute’s designated agent:

Service provider: Epsilon9 DBA Staytute

Designated agent: DMCA Agent, Epsilon9 DBA Staytute

Postal address:
PO Box 2269
Westport, WA 98595
United States

Telephone: 360.268.8801

Email: DCMA@staytute.com

This contact is only for copyright notices under § 512. It is not a public-records, privacy, legal-advice, or general support inbox.

Staytute will also designate this agent in the U.S. Copyright Office DMCA Designated Agent Directory. If the directory listing and this page ever differ, follow the directory listing and notify legal@staytute.com so we can correct this page.

Notification of claimed infringement (§ 512(c)(3))

To be effective, a written notification to the designated agent must include substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works at a single online site are covered by a single notification, a representative list of such works
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Staytute to locate the material (URL or equivalent)
  4. Information reasonably sufficient to permit Staytute to contact the complaining party, such as an address, telephone number, and email address
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

We may ignore notices that do not substantially comply with § 512(c)(3). Do not send unrelated attachments or malware.

Upon receipt of a substantially compliant notice, Staytute will, as required by § 512(c):

  • Act expeditiously to remove or disable access to the identified material
  • Take reasonable steps to promptly notify the subscriber or user who posted it
  • Document the notice and our response

Where the material is held for a Government Customer as part of a public-records or enforcement file, we may also notify that agency. Public-records retention does not prevent disabling public access to allegedly infringing user uploads while the Agency determines how to treat the record.

Counter-notification (§ 512(g))

If your material was removed or disabled, you may send a counter-notification to the designated agent that includes:

  1. Your physical or electronic signature
  2. Identification of the material that was removed or to which access was disabled, and the location at which it appeared before removal
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the Western District of Washington (or, if your address is outside the United States, for any judicial district in which Staytute may be found), and that you will accept service of process from the person who provided the original notification or that person’s agent

If we receive a valid counter-notification, we may restore the material not less than 10 and not more than 14 business days later, unless the designated agent first receives notice that the original complainant has filed an action seeking a court order to restrain you from infringing activity relating to the material.

Repeat infringers (§ 512(i)(1)(A))

Staytute adopts and reasonably implements a policy that provides for termination in appropriate circumstances of subscribers and account holders who are repeat infringers. We may terminate or suspend accounts, block uploads, and preserve records after a pattern of valid notices, court orders, or other reliable evidence of infringement. One notice does not automatically mean termination; we consider the circumstances, including whether a Government Customer requires the account for official use (in which case we coordinate with that agency).

Standard technical measures (§ 512(i)(1)(B))

Staytute accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, to the extent those measures are developed pursuant to a broad consensus of copyright owners and service providers, available on reasonable and nondiscriminatory terms, and do not impose substantial costs or burdens on our systems.

Misrepresentation (§ 512(f))

Any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages, including costs and attorneys’ fees.

Other intellectual-property claims

Trademark and other IP complaints that are not copyright claims may be sent to legal@staytute.com. They are not processed as § 512 notices unless they meet the copyright-notice elements above.
